GENERAL TERMS and CONDITIONS

AKA CARS - applicable to reservations made via the website

These General Terms and Conditions apply to all reservations and rental agreements concluded via the AKA Cars website.
By making a reservation through the website, the customer declares having read and unconditionally accepted these General Terms and Conditions.

Contract

The contract consists of the special conditions, the general conditions, and the vehicle acceptance form.
In case of any contradiction, the following order of precedence applies: special conditions > general conditions.

Conclusion of the Contract

The contract becomes valid after signing the documents, payment of the rental fee, payment of the security deposit, and signing of the vehicle acceptance form.

Right of Withdrawal

Not applicable: rental contracts concluded remotely (e.g. via the website) cannot be withdrawn.

Cancellations

Reservation: free cancellation up to 48 hours before the scheduled time. After that, cancellation fees apply (maximum equal to the rental price).
Contract: free cancellation up to 5 working days before the start date. After that, the full rental amount is due (maximum of 3 rental days).

Security Deposit

Mandatory and depending on the rental duration, vehicle type, and contractual conditions.
Payable only by credit card in the name of the renter (Visa, Mastercard, AmEx). Prepaid cards are not accepted.
The amount is blocked (pre-authorization) and used only in case of due charges or damages.

Conditions to Rent / Drive

Minimum age: 23 years.
Valid driving license held for at least 36 months. An international driving license is required if the license is not written in the Latin alphabet.
Only the renter is authorized to drive the vehicle (no subleasing).
For certain categories (luxury vehicles), two credit cards may be required.

Duration and Termination of the Contract

The contract starts upon delivery of the vehicle and ends on the scheduled return date.
Delay of more than 30 minutes → an additional rental day is charged per 24-hour period.
Failure to return the vehicle after 24 hours → complaint for misappropriation.
Failure to return the vehicle after 14 days → complaint for theft.
In case of breach of contract conditions → immediate termination + compensation equal to 10 rental days.

Vehicle

Delivered in good condition and equipped with all legally required equipment.
Any modification is prohibited without prior written approval.
Use is permitted only in Belgium and certain countries (FR, NL, DE, ES, IT, etc.).
Use outside this list is strictly prohibited.

Use of the Vehicle

Careful driving and compliance with traffic regulations are mandatory.
Smoking is prohibited (cleaning fees will apply if violated).
Standard mileage limit: 200 km/day or 6,000 km/month, unless otherwise agreed.
Prohibited uses include, but are not limited to: racing, transporting animals, subleasing, driving under the influence, off-road driving, and transport of hazardous materials.

Maintenance and Damage

The renter must check fluid levels (oil, coolant).
24/7 roadside assistance is included, except in cases of wrong fuel, empty fuel tank, lost keys, dead battery, or flat tire (these cases are chargeable).
An optional Roadside Assistance coverage may be taken out to cover these cases (except wrong fuel).
Any breakdown or damage must be reported immediately. Repairs without Aka Cars’ authorization are prohibited.

Return of the Vehicle

The vehicle must be returned in the same condition as at pickup (as recorded on the acceptance form).
Minor damage (< 4 cm) may be reported within 4 hours after receipt.

Vehicle Return (Art. 13)

The vehicle must be returned to the original rental agency unless otherwise agreed (fees may apply for a different return location).
Aka Cars is not responsible for items left in the vehicle; such items are stored for 1 month before being destroyed or handed over to the police (official documents).
The vehicle must be returned with the same fuel level and in a clean condition (cleaning or refueling charges may apply).
Return is possible during or outside opening hours; however, the vehicle condition may be assessed unilaterally by Aka Cars. In case of dispute, an independent expert may be appointed.
In case of unauthorized return outside a station, the renter remains responsible until the vehicle is effectively recovered by Aka Cars, and additional costs may be charged.

Damage and Liability (Art. 14 to 16)

The renter is responsible for damages identified upon return (comparison between pickup and return condition).
Minor damage (scratches, small dents): repair costs + administrative fees + vehicle immobilization costs.
Major damage (vehicle unusable): assessment via garage/Informex + repair, immobilization, administrative, and transport costs.
In case of an accident involving a third party, liability depends on fault. If a third party is at fault, the renter is released from liability.
If the renter is at fault or in case of material damage only, the renter must pay repair costs and the deductible (unless a liability limitation applies).

Accident and Theft (Art. 17 to 19)

In case of an accident, the accident report must be completed and submitted on the same day (or a police report in case of injuries).
In case of theft, Aka Cars and the police must be notified within 2 hours. The renter must have taken all reasonable precautions (locking the vehicle, securing keys, anti-theft devices, etc.).
If theft is confirmed, damages include:
1. replacement of the vehicle/parts
2. loss of revenue (9 rental days)
3. administrative fees

Insurance and Limitations (Art. 20)

Mandatory third-party liability insurance is included, with a deductible payable by the renter in case of a liable accident.
Third-party liability insurance does not cover the driver → optional personal accident insurance (PAI) may be taken out.
In case of gross negligence (alcohol, drugs, etc.), the insurer may exercise recourse against the renter.

Other Obligations of the Renter (Art. 21 to 24)

Fuel: the vehicle must be returned with the same fuel level.
Fines/fees: all traffic fines and charges are borne by the renter (including vehicle confiscation). Aka Cars charges administrative fees per file.
Aka Cars’ liability: providing a legally compliant vehicle in good condition. Aka Cars is not responsible for any loss of income suffered by the renter.
Payments: rental fees, fuel, cleaning, repairs, fines, administrative costs, vehicle recovery costs, etc., as detailed in the price list.
Late payment → interest and fixed penalties (different for companies and consumers).

Personal Data and Connected Vehicles (Art. 25 to 26)

The renter’s personal data is processed for contract execution, legal compliance, and Aka Cars’ legitimate interests (data may be shared with third parties or authorities).
Vehicles are connected: Aka Cars may access geolocation, fuel, mileage, mechanical signals, and emergency system data only when necessary (breakdown, accident, theft).
Infotainment systems store personal data locally (calls, navigation, music). The renter must delete this data before returning the vehicle.

Other Provisions (Art. 27 to 30)

Belgian law applies. Jurisdiction: courts of Tongeren for companies; ordinary jurisdiction rules for consumers.
Language: the contract is drawn up in the language of signature (FR/NL/EN available upon request).

Additional Conditions

Minimum age 23 years + 3 years driving license.
200 km/day included, €1 per additional km.
Missing fuel: €50 + €2.5 per liter.
Dirty vehicle: €150.
Administrative fees for fines and files: €100/hour.
The renter remains responsible for the vehicle’s immobilization period in case of damage.
Aka Cars reserves the right to request a payslip and/or proof of residence.
The renter is responsible for the number of days the vehicle is out of service to restore it to proper condition if the renter is at fault and may not disrupt Aka Cars’ operations.
It is not assumed that the renter is insured in case of damage or accident.
